3. Program description and deliverables
The Path to Transformation is a six-month coaching and education program designed to help participants improve mindset, performance, and results. Deliverables may include live or recorded group sessions, exercises and workbooks, community access, and tools or templates. We may modify non-material elements of the Program to improve content or delivery without notice.
4. Eligibility
You must be of legal age in your province or territory and capable of entering into a binding contract. The Program is not therapy, medical care, psychological counselling, financial advice, or legal advice.
5. Results disclaimer
Your results depend on your effort, participation, and circumstances. We do not guarantee outcomes, earnings, employment, health improvements, or other results.
6. Term and access window
Your access begins on the enrolment date once payment is processed and continues for six months unless otherwise stated on the checkout page. Access to recordings, communities, and materials may be time-limited. We may extend access as a courtesy but are not obligated to do so.
7. Fees, payment plans, and taxes
7.1 Program tuition. You agree to pay the tuition shown at checkout or agreed in writing during enrolment. Taxes are additional where applicable.
7.2 Payment plans. If you select a payment plan, you authorize us and our payment processor to charge your card or account on the scheduled dates. You remain responsible for the full tuition regardless of participation level.
7.3 Failed payments. If a payment fails, you will be notified to update your method of payment. We may suspend access until amounts are paid. All outstanding amounts become immediately due if an instalment is missed by more than 7 days.
7.4 Chargebacks. You agree not to file a chargeback without first contacting [email protected] to attempt resolution. Unauthorized chargebacks may be treated as a breach and referred to collections.
7.5 Currency. Unless stated otherwise, all amounts are in Canadian dollars.
8. Refunds, cancellations, and transfers
Unless stated on the checkout page, all sales are final and non-refundable. We do not pause, defer, or transfer enrolments except as required by law or expressly stated in writing. Consumer rights under applicable provincial laws remain available to you.
9. Participant responsibilities and code of conduct
You agree to:
- Attend sessions, complete exercises, and implement actions.
- Treat facilitators and participants with respect.
- Avoid harassment, discrimination, or disruptive behaviour.
- Keep community spaces free of spam and unauthorized solicitation.
We may remove or suspend any participant who violates this section without a refund.
10. Group confidentiality and recordings
We encourage privacy within the group, but we cannot guarantee confidentiality of information shared by participants. Sessions may be recorded for training and for replays available to enrolled members. By participating, you consent to audio and video recording. Do not share others’ personal stories or materials outside the Program.
11. Intellectual property and license
All Program content, including videos, workbooks, templates, text, graphics, and trademarks, is owned or licensed by us and protected by intellectual property laws. We grant you a limited, non-transferable license for personal, non-commercial use during your access window. You may not copy, distribute, adapt, sell, or create derivative works without our written permission.
12. Testimonials, likeness, and marketing permissions
If you voluntarily submit a testimonial, review, success story, or appear in Program recordings, you grant us a non-exclusive, worldwide, royalty-free license to use your name, likeness, and statements for marketing in any media, unless you withdraw consent in writing. Withdrawing consent does not require us to remove materials already in use, but we will not create new materials after withdrawal.
13. Technology and third-party tools
You are responsible for having the required internet connection, device, and software. We may use third-party platforms such as Thinkific, Zoom, Mailchimp, and payment processors. Their terms and privacy practices apply in addition to ours.
14. Health, medical, and financial disclaimers
The Program is educational. It is not a substitute for professional advice. Do not disregard medical or psychological advice because of Program content. You are responsible for your decisions and actions.
15. Privacy and data protection
We handle personal information in accordance with Canadian law, including PIPEDA, and our Privacy Policy. We collect and use personal information to deliver the Program, communicate with you, process payments, and improve services. For questions or access requests, contact [email protected].
16. Termination and suspension
We may suspend or terminate access if you breach these Terms or engage in conduct that harms other participants or the Program. Your obligation to pay all fees remains, and no refund will be provided except where required by law.
17. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your participation. Our total liability for any claim will not exceed the amount you paid for the Program in the twelve months before the claim.
18. Indemnity
You agree to indemnify and hold harmless Peak Results Academy, its directors, employees, contractors, and affiliates from claims and expenses arising from your breach of these Terms or misuse of the Program.
19. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including outages, strikes, pandemics, or governmental actions. If a live session is affected, a reasonable make-good will be provided.
20. Changes to the Program or these Terms
We may update these Terms or make non-material changes to Program elements to improve the experience. Material changes will be posted with an updated date. Continued access after changes means you accept the updated Terms.
21. Governing law and venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
22. Dispute resolution
Before commencing a claim, the parties will attempt good-faith resolution through a written notice and a 30-day negotiation period. This section does not prevent either party from seeking injunctive relief.
23. Severability and entire agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with the checkout page and any written addenda, are the entire agreement regarding the Program and replace all prior discussions.
